Probating Estates

When a person dies, their estate passes through what is known as “probate.” This process ensures that all debts are settled by a person’s estate and that estate assets are passed to beneficiaries either named in a will or by the laws of intestacy. This is a very time consuming process that can be especially difficult for a grieving family. A Florida Probate Attorney can oversee this process and make sure that all debts are paid and assets are distributed properly.

A person appointed by the Court to serve as personal representative (executor) of an estate will need to make sure that an accurate inventory is taken of all items and goods to ensure that no estate assets are hidden or omitted. The personal representative also needs to make sure that proper steps are taken to notify creditors of a person’s death so these creditors can file a claim with the estate. In Florida, a personal representative must hire an attorney who will guide them through the probate process and report to the Court.

Sperry Law Firm has experience probating estates and will take the necessary steps to make sure that this process moves smoothly. It is a complicated process that can be made more difficult if there are family disputes or other issues. An attorney can help alleviate disputes among beneficiaries and make sure the estate assets are distributed properly, thereby allowing the family to find closure after the probate process is completed.
